Posted by: xantham Shain, of Vero Beach, was charged with violating probation when a small amount of marijuana and a Viagra pill were found in his bedroom during a search by probation officers last May 19.
Attorney Bob Stone asked Vaughn to show compassion because Shain has led an exemplary life since he committed the sex offense as a 14-year-old. Stone told the court Shain was being vigorously prosecuted because the victim is the son of a local law-enforcement officer.
Assistant State Attorney Ryan Butler said Shain deserved prison because he was given "the break of a lifetime" twice, when he was given probation for the original offense and when his probation was extended when he violated curfew in 2001.
"The state should be concerned when a registered sexual predator is found with Viagra and admits to smoking marijuana," Butler said.
The father of Shain's victim told Vaughn the victim, who now is 18, "is an angry young man who is confused about his place in society" because of the sex offense that occurred 12 years ago.
